These pages will let you know our terms and conditions on which we supply any of our products listed on our website www.­russke­llfur­niture.­co.­uk or for sale in any of our retail outlets. Please read these terms and conditions carefully before ordering any items from our site, showrooms or over the phone. You should understand that by ordering any of our items, you agree to be bound by these terms and conditions.

These terms and conditions can be requested in writing or can be printed off this site for your reference. If you do not accept these terms and conditions, you will not be able to order any items from our site.

1. About Us

  1. www.­russke­llfur­niture.­co.­uk is a site owned and run by Russkell Upholstery Ltd, Darwen, Lancashire. We are registered in England and Wales under company number 1401117 and our registered office is at Olive Mill, Olive Lane, Darwen, Lancashire, BB3 3DJ, this is also our main trading address. Our registered VAT no. is 325 8026 68.

2. Your contract with Us

  1. When you place an order via our website you will receive an e-mail from us confirming that your order has been received and accepted. This will be known as your ‘Order Confirmation’. The contract between Russkell Furniture and yourselves will be formed once we have sent the ‘Order Confirmation’ and you have received it. This will apply to all items ordered either via our website or verbally.

  2. All contracts between Russkell Furniture and yourselves will relate only to those items you have ordered and that we have confirmed in your ‘Order Confirmation’. We are under no obligation to supply any other items which may have been part of your order unless these items appear on a separate or edited ‘Order Confirmation’.

3. Your Rights

  1. If you have entered into a contract with Russkell and have received an item from us then you as a consumer have the right to cancel said contract. You may cancel any contract at any time although if you wish to cancel your contract after the items have been delivered this must be done within 7 days, beginning on the date of you receive your items. If this is the case, you will receive a refund of the price paid for the items in accordance with our refunds and returns policy (see clause 7 below) Please note that if your items have been delivered before the date of cancellation, you must return the items to our showroom at your cost and at your risk within [21] days of cancellation but in lieu of that obligation we will collect any ‘made to order’ and some larger items from you by arrangement within 21 days of cancellation. You will be responsible for the collection costs we incur. Exceptions on cancellation refunds will apply if your item has been ‘made to order’ and it is not from our ‘homeware’ range. (see clause 7 below)

  2. If you wish to cancel a Contract, these procedures must be followed. You must inform us in writing or by email within the cancellation period. (see 3.1 above). Please note, it is essential that any items being returned to Russkell Furniture must be in the same condition in which you received them. In simple terms this means that any cancelled items must be in perfect condition, suitable for resale and undamaged in any way. All items returned to us as a ‘contract cancellation’ must be returned in original packaging as received. If you are awaiting an item to be returned to us then you as a consumer have a legal obligation to take care of these items until they are returned to Russkell Furniture.

  3. Russkell Furniture reserve the right to cancel any order, up to the point of despatch, for any product we are unable to fulfil or we feel the quality of the product does not meet our standards.

4. Delivery and Guarantees

  1. When your ‘made to order’ items are ready you will be contacted by either Russkell Furniture or one of our delivery partners. A convenient date and will be arranged for delivery to the address specified by you. Please note that any smaller items from our homeware ranges and marked as ‘in stock’ on our website will be automatically delivered via our parcel carrier between (7-21) working days (excluding bank Holidays) and a signature may be required to complete the delivery. Exception will apply on our occasional chairs and chaise lounge. They will be delivered by Russkell Furniture or one of our delivery partners. Deliveries for these items can take up to 21 working days. (excluding Bank Holidays)

  2. Either Russkell Furniture or one of our delivery partners will deliver your items to any mainland UK address. (For International shipping, including Ireland, see our International Sections below) All our ’made to order’ items will be charged at £79 for up to 4 seats, a further £10 will be charged for every seat thereafter. Exceptions apply on Tub Chairs. They will be delivered via our specialst furniture one man couriers, although this service will be door delivery and not in-house. If full delivery service into a property is required for this item then the full price of £79 will be charged. These delivery charges are for Mainland UK only (excluding Northern Ireland). Please note the following postcodes will be subject to an additional delivery charge.

  3. For destinations outside this area please contact us for a transport & delivery charge. Any additional charges or special offers will be clearly marked and will be indicated when you place your order. Proof of identification from you may be required when making a delivery to you.

  4. You are required to take delivery of any items delivered by our furniture company on the date agreed between Russkell Furniture and yourselves. We reserve the right to charge an additional redelivery fee. Please note this payment must be made and cleared before redelivery.

  5. For deliveries of large items of furniture to addresses in mainland UK, our delivery companies will always be vigilant and careful when carrying and handling your items. Neither Russkell Furniture nor the delivery company can be held liable for any accidental damage to any properties, land or person however caused. Deliveries will only be made on these terms and drivers will only enter properties on these conditions.

  6. Our delivery service for large items will be placed in a room of your choice at ground floor level. An extra charge will be incurred if items are to be delivered to any other floors or balconies. Items may be unpacked and assembled, however a signature will be required at this time by the customer to acknowledge that the items are in perfect saleable condition. The signature of the person accepting delivery at the address will be used as proof that you or the person to whom the order is addressed has received their items. Please note that any returns at a later date, for whatever reason must be repacked in its original packaging and condition. For this reason alone our delivery drivers will not remove any packaging from your property or delivery address.

  7. You, the customer are responsible for checking the condition of your larger items delivered by our furniture carrier specialists at the time of delivery and any issues or queries must highlighted at this time. The delivery carrier will then communicate all queries relating to this directly to Russkell Furniture and we will liase with you, the customer, on how to resolve these issues.

  8. It is the customer’s responsibility to ensure adequate property access for the delivery. Any furniture items delivered and that have to be returned due to lack of access will occur an extra redelivery charge, which will be payable before redeliver occurs.

  9. Any details within clause 4 made by Russkell Furniture apply in addition to your statutory consumer rights in relation to faulty or mis-described goods. These rights are not affected by the guarantee.

  10. All ‘made to order’ sofa frames and chairs made by Russkell Furniture or our specialist partners are guaranteed for 5 years from the date of delivery. This guarantee is against faulty workmanship and/or faulty materials, with the exception of fillings and coverings.

  11. Our guarantees do not cover fair wear and tear, neglect, abuse or misuse of your goods, loss or damage (including rusting and corrosion) due to unreasonable exposure to water, heat or weather; loss or damage due to fire, smoke, explosion, lightning, sunlight, infestation by animals or boring insects, or theft, or accidental damage or loss caused by a third party.

  12. If you need to make a claim under guarantee please contact our registered office in writing. You are required to inform us of your sales invoice number, your address and contact details. We will also require a summary of your claim and we will require images of the problem. We will then confirm we have received your claim and will then contact you further within a reasonable amount of time as to whether your claim is valid.

  13. If a claim under guarantee is accepted Russkell Furniture will endeavour to repair the items at your property free of charge or will be repaired at our factory.

  14. Russkell Furniture will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered goods to yourselves. This does not affect your statutory rights.

  15. Russkell Furniture guarantees are limited to goods sold and retained in mainland United Kingdom (excluding Northern Ireland) and used solely for private and domestic purposes.

  16. Our delivery partners will expect to deliver your ‘made to order’ items within 10 working days of them being dispatched from our factory. If the customer fails to accept delivery within this time period then you will be charged an extra fee if the goods have to be sent back to us and then redelivered. Please note that this is for larger or ‘made to order’ items which cannot be sent via postal carrier. Should you not wish to pay this we reserve the right to cancel your order and refund you accordingly.

  17. Time of delivery is not of the essence in these Terms and Conditions of Trading. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of Russkell Furniture or delay due to any reasonable rescheduling of delivery.

5. Prices and Payment

  1. The price of any of our items for sale on our website will be as quoted, except in cases of obvious error.

  2. The prices are all in Pound Sterling and include VAT but not delivery charge.

  3. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation.

  4. On rare occasions, despite our best efforts, some of the items listed on our site may be priced incorrectly. We will normally confirm prices and payment breakdown as part of our ‘order confirmation’. Where an items correct price is less than our stated price, we will charge the lower amount when dispatching the item to you. If an items correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the item, or reject your order and notify you of such rejection.

  5. Russkell Furniture are under no obligation to provide the items to you at the incorrect (lower) price, even after we have sent you an ‘order confirmation’ if the pricing error is obvious and could have been recognized by the customer as a mis-pricing.

  6. Payment for all items purchased via our website must be made by credit or debit card. We accept payment by Visa, Mastercard, Delta/Connect and Maestro and is run the Worldpay.

  7. ’Made to Order’ items will not be dispatched for delivery until full payment has been received. The customer must pay 50% deposit on all ‘made to order’ items and then a final 50% payment to complete the sale when the item is due for delivery. For all homeware items and items marked as ‘in stock’ the customer must pay full price at checkout.

  8. Ownership of the items purchased will only pass to the customer when Russkell Furniture receive full and final payment of all sums due in respect of the items including delivery charges (if any).

6. Products

  1. All written descriptions or images of the items on our site are correct at the time of publication to our site. We continuously develop our items and reserve the right to amend the specification of items without prior notice in relation to future sales.

  2. The measurements of the items, particularly in the homeware range are as accurate as possible but it should be noted that they are approximate.

  3. Leather goods supplied by us are hand made using natural raw materials. As such the leather goods will have natural marks such as healed scars and barbed wire nicks, which signify genuine leather. Leather goods are made from a natural raw material and accordingly they may not be uniform in colour or texture. Only the finest hides are selected but they will show natural marks and scars on the hide which is normal and common place and part of the authenticity of real leather.

  4. Many of our items are applied with various finishes to the exterior. Due to the nature of the materials used, finishes may vary. A large proportion of our product range is handcrafted and is therefore subject to changes in colour and finish. Although overall quality is not affected, this is an inherent part of our stockholding and should be viewed as such.

  5. We will endeavour to match the colour and texture of the fabric/leather of your sofa to the samples chosen as accurately as possible, but variations in both the colour and texture may occur from batch to batch.

  6. It is the responsibility of the customer to check that all the details on the ‘order confirmation’ are correct including the exact specifications of the items, price, payment structure and delivery details.

  7. Russkell Furniture items are intended solely for domestic use in the UK and we give no guarantees in respect of the use of our items for commercial use. Russkell Furniture are not responsible for any non-domestic or commercial use of our items and by agreeing to these terms and conditions, you agree that you will use the items exclusively for domestic use.

  8. If any items delivered via our postal courier service are delivered damaged or faulty or are otherwise incorrect, you must notify us within 24 hours of delivery and we will arrange to inspect the items and if they are found to be damaged, faulty or incorrect we will repair or replace them as appropriate and arrange for the repaired or replaced items to be delivered to you at no additional charge. Your notification under this clause should be put in writing and sent by email to sales@russkellfurniture.co.uk or by letter delivered to our showroom.

7. Online Purchases, Refunds and Returns

  1. Should you not be happy with your item you are welcome to return it to us. You must notify us within 7 days from your date of delivery of your intention to return a product.

  2. When you return an item to us we will process the refund agreed by yourselves and Russkell Furniture within 30 days of receiving the correct notice to cancel. You will be charged a collection cost for any non-faulty or cancelled contract returns along with a restocking/­admin charge at the management’s discretion. Please note that the collection of unwanted items does not apply to smaller items on their own (i.e. anything from our ‘homeware’ ranges or smaller items of furniture that have been delivered by parcel courier.) Any cancelled or unwanted larger ‘homeware’ accessories (eg furniture & desks) and occasional chairs will be collected but please note that a collection charge will be deducted from your refund. Should you wish to return your items we will provide a full refund for the purchase price of the goods. (excluding original delivery charge) However the buyer is responsible for any carriage costs involved returning the goods.
    The customer must also ensure that these items arrive with us at our registered office address as we do not accept liability for goods lost in transit.

  3. All return items must have original tags and packaging; and have not been installed, used, or modified.

  4. All sale items are non-returnable/­refundable.

  5. If you wish to return a ‘made to order’ or one off ’catalogue’ item that we do not hold in stock there will be a a 40% restocking fee as these items are made or ordered specifically for you. This charge will be deducted from your refund and agreed with you before refund will be issued.

  6. RETURNING AN ITEM BOUGHT THROUGH OUR RETAIL OUTLETS. If you wish to return an item that has been purchased through one of our retail outlets then please read the following information.If you are unhappy with your puchase or have just simply changed your mind then you are welcome to bring it back to our shop within 30 days unused and undamaged and still in original packaging. You will be offered a credit note for the value of the item, which will be valid for 6 months from the date of return. If you have purchased a larger ’homeware’ item and it has been delivered to you by us then you are still welcome to return it should you need too. You must inform us of your intention within 7 days of receipt of item and we will arrange a collection. Your item will be inspected and we will issue a credit note (less a collection charge). All larger items should be still in original packaging and be unused.

8. Our Liabilty

  1. We warrant to you that any item purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.

  2. Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the item you purchased.

  3. This does not include or limit in any way our liability:

    • For death or personal injury caused by our negligence;

    • Under section 2(3) of the Consumer Protection Act 1987;

    • For fraud or fraudulent misrep­res­en­ta­tion; or

    • For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
      We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us (such as loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time)
      however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

9. Fabric Samples

  1. You can obtain up to 5 free fabric/leather samples from us through the order process prior to ordering our items, to enable you to visualise what the material will look like. While we try to ensure that the items are as similar as possible to those displayed on-line or through fabric samples, there may be natural variations & even dye batch variation.

  2. If you require additional or further fabric samples, we reserve the right to make a charge.

  3. We currently only ship fabric samples to Mainland UK

  4. Fabric samples are only available to private customers. We reserve the right to withdraw this service if it is suspected that samples are being used in a retail or non domestic situation.

10. Transfer of Contracts

  1. The contract between you and Russkell Furniture is final on you and us and on our respective partners.

  2. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.

  3. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

11. Severability

If any of these terms and conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

International Shipping & Returns

Please note:

  1. All furniture & accessories will be delivered by our professional shipping agents
  2. In Europe and many other countries many items will only be delivered to kerbside only.
  3. Duty Payments

    IT IS ADVISABLE TO CHECK IMPORT CHARGES ON ALL YOUR INTENDED PURCHASES BEFORE YOU ORDER.

    Products delivered to some destinations, mainly outside the EU, may be subject to taxes, fees, levies or other charges, which are imposed by local legislation. The recipient of the products is responsible for all customs charges for their export and import, and will be required to pay any additional charges, including import duty, formal customs entry, taxes, levies and other charges. Russkell Furniture have no control over these charges and cannot predict what they may be, so we’re unable to offer any assistance on these processes.

  4. Payment & VAT

    Payment for products and delivery services is to be made in pounds Sterling. All prices shown on the website for both products and delivery services are inclusive of any applicable UK VAT. This means that the total price you pay us for is always the same, regardless of whether or not UK VAT is chargeable.

    If you’re either a non-UK resident and wish to claim back VAT on orders for delivery outside the EU, or you’re an EU business customer expecting to buy goods and delivery services without UK VAT on them you may prefer to place your order through specialsit export company and not through our website. Shipping costs charged by using these services will usually be higher than the cost of the delivery service offered via the website.

  5. Your postage & packing costs will be confirmed to you before you pay for your order by our Sales Team, you then have the option to carry on with the purchase or cancel the sale.
  6. We aim to deliver your items in the quickest time possible. For all ’homeware’ products and items we have in stock we aim to have them despatched within 10 working days and delivered with 21 working days.
  7. Changing, Cancelling or returning an International Order

    We’re sorry that in most circumstances it’s not possible to make changes to your order once you’ve placed it. If you’d like to add products to your order, please place a new order for these items.

    If your order has left our warehouse for delivery to you, follow our International Returns procedure in the event of any unwanted products.

    Internationally shipped items must be unused and returned in the original packaging and in a re-saleable condition within 35 days of receipt of your goods. Russkell Furniture will only refund the price paid for the goods in full once returned to our warehouse, but shipping & collection costs and any other duties or taxes will be deducted from your refund. Our returns policy does not affect your legal and statutory consumer rights. It is advisable to use a reliable postal tracking service and gain proof of postage as no refunds will be issued without one.

  8. Please note that any refund will be in sterling, and may therefore not be exactly the amound paid, due to constant changes in exhange rates.

    Please note that if a ’made to order’ or catalogue product that we order specifically for you is shipped internationally then it cannot be returned unless faulty.
